LinkedIn Jobs Terms and Conditions
Welcome, and thanks for using LinkedIn's jobs posting platform and related products and services (“LinkedIn Jobs”). You agree that by accessing, posting, promoting a job, or using LinkedIn Jobs for hiring, you enter a legal binding agreement with LinkedIn.
1. Agreement
The following terms and conditions govern your access and use of LinkedIn Jobs:
- These LinkedIn Jobs Terms and Conditions
- The LinkedIn Jobs Policies
- The LinkedIn User Agreement and Privacy Policy
- The LinkedIn Terms for Paid Services applicable to LinkedIn Jobs
- The LinkedIn Data Processing Agreement (“DPA”) under which you and your entity are a “Customer”
- Additional terms and conditions you are agree to when using LinkedIn Jobs
To the extent of any conflict between any of the terms and conditions listed above or any different agreements that you have with LinkedIn, these Jobs Terms and Conditions and any feature-specific terms govern with respect to the use of LinkedIn Jobs. However, with respect to entities using LinkedIn Jobs purchased under or subject to an order form governed by the LinkedIn Subscription Agreement between you and your company, such as job slots, the terms of the LinkedIn Subscription Agreement shall govern.
If you are posting or promoting a job, reviewing job applicants or otherwise using LinkedIn Jobs on behalf of a company, organization or other entity, you represent and warrant that you have the authority to do so and to bind that entity to these Jobs Terms and Conditions. In this event, LinkedIn may hold you responsible for violations of this agreement by that entity, and "you," "your" and "party" will also refer and apply to that entity. If you post or promote jobs, review job applicants, or otherwise use LinkedIn Jobs on behalf of an entity, you agree that LinkedIn may share information about your job, activity, purchases, payments and use of LinkedIn Jobs with that entity, including its representatives and agents (including the administrator of a LinkedIn Page for that entity). If that entity indicates that you are no longer authorized to access, purchase, make payments for or use LinkedIn Jobs on its behalf (e.g., if you leave that business or changes roles within that business), you agree that LinkedIn may prevent you from using LinkedIn Jobs on behalf of that entity. LinkedIn reserves the right to treat that entity as the contracting entity for purposes of any preceding use of LinkedIn Jobs (this includes treating the entity as the controller of any data related to LinkedIn Jobs).
2. Your Use of LinkedIn Jobs
LinkedIn Jobs are designed to help you reach quality candidates for job opportunities. You are responsible for:
- All job posts and content submitted by you or on your behalf through LinkedIn Jobs including but not limited to the job descriptions, trademarks, images, and pixels used on LinkedIn (collectively, your "Job Posts").
- All websites, services, or content to which Job Posts may direct job seekers ("Landing Pages").
- Any activity conducted through your account, including any purchases made or charges incurred. You may not resell or transfer access to LinkedIn Jobs or your LinkedIn Account to any other party.
- Your hiring process including screening questions, compensation, benefits, job qualifications, interview criteria, and candidate outreach or review, or hiring decisions whether or not LinkedIn has provided information to assist you.
- Your data protection practices under applicable law and in compliance with your privacy notice governing your hiring process including collection, use, and deletion of job applicant personal data.
LinkedIn reserves the right to restrict, suspend, or terminate your access to LinkedIn Jobs or your LinkedIn account if you violate these Jobs Terms & Conditions or are misusing or abusing LinkedIn Jobs.
You agree to receive communications from LinkedIn via email and/or postings on LinkedIn Jobs, including communications regarding your jobs and promotional messages.
3. Job Posts & Conduct
All Job Posts must comply with the LinkedIn Jobs Policies as well as all applicable laws. We periodically update our policies, so please review them regularly. We reserve the right to change our policies at any time without notice.
Each Job Post must be for one job opportunity for the specific position listed in your Job Post; it is not permitted for a Job Post to solicit applications for more than one position, including Job Posts that solicit applications from individuals generally interested in future roles with your company.
Without limiting the prohibitions in the User Agreement or any other applicable agreement, you agree that you will not, and you will not enable or authorize any third party by virtue of the Job Posts or use of LinkedIn Jobs, to:
- Provide identifiable candidate resume or application data to any other parties, except to your service providers, contractors, and data subprocessors in compliance with these Jobs Terms and Conditions, your privacy notice, and applicable law for purposes of hiring the candidate only.
- “Spam” or otherwise contact applicants for purposes other than related to the specific employment opportunity described in the posting.
- Harass, stalk, or contact any applicant after they have asked not to be contacted.
- Engage in illegal or fraudulent conduct.
- Copy, duplicate, replicate, scrape or otherwise reproduce jobs from a hiring company’s website and upload them to LinkedIn as Job Posts without the hiring company’s prior knowledge and authorization. Where a hiring company informs LinkedIn that you have done so without its prior knowledge and authorization, LinkedIn reserves the right to remove such Job Posts immediately and without prior notice.
- In order to post a job for a position at a third-party entity, you must have an active contract in place with the third-party entity providing active recruiting services beyond job posting for the applicable position.
- Except as expressly authorized by LinkedIn in writing, use any automated means or form of scraping or data extraction to access, modify, download, query or otherwise collect information from LinkedIn.
- Except as expressly authorized by LinkedIn in writing, copy, modify or create derivative works of LinkedIn Jobs or any related technology.
LinkedIn may, in its sole discretion, modify, or terminate any part or all of the LinkedIn Jobs services or suspend your ability to use LinkedIn Jobs. LinkedIn may reject or remove any Job Post at any time for any reason, regardless of whether or not such Job Post was previously accepted or available on LinkedIn.
4. Promoted Jobs
LinkedIn Jobs also offers the option to “sponsor” or “promote” a Job Post for a fee (“Promoted Jobs”). Promoted Jobs may have access to exclusive promoted channels or may receive a higher ranking relative to free Job Posts as further described in LinkedIn Jobs (such as when you create a Job Posting or use Promoted Jobs), our websites, and in our help center.
LinkedIn may, in its sole discretion, require a Job Post to be promoted, for example in order to improve the quality and effectiveness of Job Posts, to prevent abuse, or for any other reason. Job Posts that require promotion may include, but are not limited to, Job Posts that are reposted within a certain time period and Job Posts by companies with generic names (such as “Confidential Company”).
You agree to pay all applicable fees and charges that LinkedIn calculates for your use of LinkedIn Jobs (“Fees”). Fees will be calculated based solely on LinkedIn’s measurements for the Promoted Jobs, and on the basis and at the rate shown when a campaign, order or other purchase was submitted through your account ("Rate"), e.g., price per impression, click, application, or other conversion or period, whether with a daily or total budget or other budget options.
You also agree to pay all applicable taxes, government charges and foreign exchange fees. For these purposes, taxes include all federal, state, and local sales, use, gross receipts, VAT, GST, levies and similar transaction taxes.
LinkedIn will periodically charge your payment method at the applicable Rate. All amounts paid are non-refundable. You remain responsible for any uncollected amounts. LinkedIn may charge interest for any overdue amounts at the rate of the lesser of 1% per month or the lawful maximum, and you agree to reimburse us for all collection costs for overdue amounts. To the extent you have not spent your designated budget, you may limit or stop additional charges by editing the budget through your account by closing your job or ending promotion.
Your Fees will be determined solely on LinkedIn's tracking mechanisms, which LinkedIn may modify from time to time. LinkedIn has systems in place to attempt to detect and prevent certain forms of automated and fraudulent activity, but no such systems are perfect, and bot activity, click fraud, fraudulent leads, and other third-party invalid activity (collectively, “Invalid Activity”) may occur. You understand and agree that Invalid Activity may affect the Fees you are charged, and that LinkedIn is not liable for such Invalid Activity. LinkedIn may choose to notify you of Invalid Activity in its discretion, but it is not obligated to do so. You further understand and agree that technological issues such as errors, defects, or software bugs (individually and collectively, "Technological Issue(s)”) may exist and that LinkedIn is not liable for such Technological Issues.
If you wish to dispute any Fees, including those based on Invalid Activity or Technological Issues, your sole and exclusive remedy will be to make a claim for a Promoted Jobs credit within 90 days of the date of the Fees in dispute, and LinkedIn's exclusive liability is, in LinkedIn's sole discretion, to issue Promoted Jobs credit. Any Promoted Jobs credits that you may accrue are non-refundable and non-transferable, and must be used prior to termination of this Agreement or your LinkedIn Jobs account.
5. Intellectual Property Rights and Legal Compliance
You grant to LinkedIn a non-exclusive, worldwide, royalty-free, sublicensable and transferable license to use, copy, modify, distribute and publish your Job Posts in connection with the performance of LinkedIn Jobs (including for marketing and promotional purposes). You represent and warrant that you own or have all necessary rights (including intellectual property rights) to your Job Posts (including to grant the license above).
In connection with our compliance and transparency efforts, we may preserve and display copies of your Job Posts and information about them, including after the conclusion of your hiring campaign or termination of this Agreement. This information may include, but is not limited to, estimated impressions, the entity who paid for the post, and targeting parameters.
If you choose to provide suggestions or feedback to LinkedIn about LinkedIn Jobs, you agree that LinkedIn can (but does not have to) use and share such feedback for any purpose without compensation to you.
Each party will comply with laws, regulations, and governmental requirements applicable to you or your job applicants (collectively, "Applicable Law") relating to its performance of these terms, including privacy and security laws (e.g., the EU General Data Protection Regulation (GDPR) and EU Directive 2002/58/EC, each as amended and implemented in various EU countries and the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA)), including with respect to your collection and use of personal data in your hiring process. Without limiting the generality of the foregoing, you represent that you have a privacy notice for job applicants that complies with Applicable Law and that covers collection, use, and deletion of job applicant personal data. Additionally, you represent that your use of LinkedIn Jobs and your hiring process complies with applicable laws pertaining to employment and hiring, including laws related to employment discrimination.
6. Disclaimer of Warranties
To the extent allowed under law, in addition to disclaiming all implied warranties and other warranties as provided in the User Agreement, LinkedIn and its affiliates (as defined in the User Agreement) disclaim all warranties regarding LinkedIn Jobs, including but not limited to any warranty relating to (i) relating to the accuracy of any candidate information (including but not limited to candidate applications, candidate identities, recommendations, connections, and references, (ii) candidate or hire speed, ease, outcomes, or quality when using LinkedIn Jobs or (iii) that your use of LinkedIn Jobs complies with laws applicable to you as an employer or hiring company.
7. Indemnity
Notwithstanding any review or approval of any Job Post by LinkedIn, you agree to indemnify LinkedIn and its affiliates (as defined in the User Agreement), and hold LinkedIn and its affiliates harmless from any damages, losses and costs (including, but not limited to, reasonable attorneys' fees) related to third party claims or proceedings, arising out of or related to your Job Posts, Landing Pages, use of LinkedIn Jobs, your hiring process (including any employment decisions), and breach of these Jobs Terms and Conditions.
8. Limitation of Liability
To the fullest extent permitted by law, neither party, including its respective affiliates, will be liable to the other in connection with these Jobs Terms and Conditions for lost profits or lost business opportunities, loss of data, or any indirect, incidental, consequential, special or punitive damages.
Neither party, including its respective affiliates, will be liable to the other in connection with these Jobs Terms and Conditions for an amount that exceeds the greater of (a) 5 times the total fees paid or payable to LinkedIn during the 1-month period before the event giving rise to the liability or (b) USD $100.00.
These limitations of liability do not apply to a party's (i) payment; confidentiality or indemnification obligations; (ii) liability for fraud, gross negligence or intentional misconduct; (iii) liability for death or personal injury; or (iv) violation of the other party's intellectual property rights.
9. Miscellaneous
These Jobs Terms and Conditions do not create a partnership, agency relationship, employer relationship or joint venture between the parties. If these Jobs Terms and Conditions are translated into a language other than English, the translation is for convenience only, and the English language version will govern. LinkedIn may change the terms of these Jobs Terms and Conditions by notice to you (for example, providing the changed terms to you when you create or edit a Job Post). If you do not agree to the changed terms, you must stop using LinkedIn Jobs. Following termination or expiration of this Agreement, any provisions of this Agreement that by their nature should survive termination shall survive termination, including, but not limited to Sections 4 through 9.
The LinkedIn entity entering into these Jobs Terms and Conditions with you is determined pursuant to the Contracting Entity Terms. If an issue arises under these Jobs Terms and Conditions (including non-contractual disputes or claims) and the contracting entity based on the Contracting Entity Terms is (a) LinkedIn Corporation, then these Jobs Terms and Conditions are governed by the laws of the State of California, and any action or proceeding (including those arising from non-contractual disputes or claims) related to these Jobs Terms and Conditions will be brought in the federal or state courts of Santa Clara County, California, USA ; (b) LinkedIn Ireland Unlimited Company, then these Jobs Terms and Conditions are governed by the laws of Ireland, and any action or proceeding (including those arising from non-contractual disputes or claims) related to these Jobs Terms and Conditions will be brought in Dublin, Ireland; (c) LinkedIn Singapore, then these Jobs Terms and Conditions are governed by the laws of Singapore, and any action or proceeding (including those arising from non-contractual disputes or claims) related to these Jobs Terms and Conditions will be brought in Singapore, or (d) Beijing Lingyin Information Technology Co., Ltd, then these Jobs Terms and Conditions are governed by the laws of the People's Republic of China, and any action or proceeding (including those arising from non-contractual disputes or claims) related to these Jobs Terms and Conditions will be brought in China. Each party irrevocably submits to the jurisdiction and venue of the applicable courts. The prevailing party in any litigation may seek to recover its legal fees and costs. are governed by the laws of the State of California, and any action or proceeding (including those arising from non-contractual disputes or claims) related to these Jobs Terms and Conditions will be brought in the federal or state courts of Santa Clara County, California, USA ; (b) LinkedIn Ireland Unlimited Company, then these Jobs Terms and Conditions are governed by the laws of Ireland, and any action or proceeding (including those arising from non-contractual disputes or claims) related to these Jobs Terms and Conditions will be brought in Dublin, Ireland; (c) LinkedIn Singapore, then these Jobs Terms and Conditions are governed by the laws of Singapore, and any action or proceeding (including those arising from non-contractual disputes or claims) related to these Jobs Terms and Conditions will be brought in Singapore, or (d) Beijing Lingyin Information Technology Co., Ltd, then these Jobs Terms and Conditions are governed by the laws of the People's Republic of China, and any action or proceeding (including those arising from non-contractual disputes or claims) related to these Jobs Terms and Conditions will be brought in China. Each party irrevocably submits to the jurisdiction and venue of the applicable courts. The prevailing party in any litigation may seek to recover its legal fees and costs.
