Abstract
Einstückige kapillare Mikroküvette (1) zur Messung chemischer Blutwerte, die einen Grundkörper (2) und eine die Blutprobe aufnehmende Ausnehmung (3) mit einem Messbereich (4) in dem Grundkörper aufweist, wobei die Ausnehmung (3) definiert ist durch zwei einander gegenüberliegende, im Wesentlichen parallele innere Oberflächen (5, 6) des Grundkörpers (2), einen äußeren Umfangsrand (7) mit einem Probeneinlass (8) am äußeren Ende der Mikroküvette, wobei der Umfangsrand (7) vom Probeneinlass (8) ausgehend schräg nach hinten verläuft, und einen inneren Umfangsbereich (9) mit einem Kanal (10) von höherer Kapillarkraft als der Messbereich (4), wobei beide Enden des Kanals (10) mit der Umgebung der Mikroküvette (1) in Verbindung stehen und dieser Kanal (10) durch eine innere Endwand dieses inneren Umfangsbereichs (9) und zwei im wesentlichen ebene Oberflächen dieses Grundkörpers definiert ist und sich der Abstand zwischen den beiden im wesentlichen ebenen Oberflächen dieses Grundkörpers (2) in Richtung weg von dieser inneren Endwand dieses inneren Umfangsbereichs...

- Tenor
- Der Xa-Zivilsenat des Bundesgerichtshofs hat auf die mündliche Verhandlung vom 25. November 2010 für Recht erkannt:
Auf die Berufung der Beklagten wird das am 2. Mai 2007 verkündete Urteil des 4. Senats (Nichtigkeitssenats) des Bundespatent gerichts unter Abweisung der weitergehenden Klage abgeändert.
Das wird mit Wirkung für die Bundesrepublik Deutschland dadurch teilweise für nichtig erklärt, dass der nicht angegriffene Patentanspruch 3 in seiner Rückbeziehung über Patentanspruch 2 auf Patentanspruch 1 in der Fassung des erteilten Patents bestehen bleibt und an die Stelle der angegriffenen Patentansprüche 1, 2 sowie 4 bis 8 folgende Patentansprüche treten:europäische Patent 821 784
Claims (5)
- Einstückige kapillare Mikroküvette (
1 ) zur Messung chemischer Blutwerte, die einen Grundkörper (2 ) und eine die Blutprobe aufnehmende Ausnehmung (3 ) mit einem Messbereich (4 ) in dem Grundkörper aufweist, wobei die Ausnehmung (3 ) definiert ist durch zwei einander gegenüberliegende, im Wesentlichen parallele innere Oberflächen (5 ,6 ) des Grundkörpers (2 ), einen äußeren Umfangsrand (7 ) mit einem Probeneinlass (8 ) am äußeren Ende der Mikroküvette, wobei der Umfangsrand (7 ) vom Probeneinlass (8 ) ausgehend schräg nach hinten verläuft, und einen inneren Umfangsbereich (9 ) mit einem Kanal (10 ) von höherer Kapillarkraft als der Messbereich (4 ), wobei beide Enden des Kanals (10 ) mit der Umgebung der Mikroküvette (1 ) in Verbindung stehen und dieser Kanal (10 ) durch eine innere Endwand dieses inneren Umfangsbereichs (9 ) und zwei im wesentlichen ebene Oberflächen dieses Grundkörpers definiert ist und sich der Abstand zwischen den beiden im wesentlichen ebenen Oberflächen dieses Grundkörpers (2 ) in Richtung weg von dieser inneren Endwand dieses inneren Umfangsbereichs (9 ) vergrößert. - Mikroküvette (
1 ) nach Anspruch 1, wobei diese Ausnehmung (3 ) ein vorgegebenes Volumen aufweist. - Mikroküvette (
1 ) nach Anspruch 1, wobei diese Ausnehmung (3 ) ein trockenes Reagenz in vorgegebener Menge enthält. - Mikroküvette (
1 ) nach Anspruch 1 zur Verwendung bei der Bestimmung des Hämoglobingehalts von unverdünntem Vollblut, wobei dieser Messbereich eine Tiefe aufweist, die 0,15 mm nicht übersteigt. - Mikroküvette (
1 ) nach Anspruch 4, wobei der Hämoglobingehalt nach dem Azidmethämoglobin-Verfahren bestimmt wird.
