Claims
STATEMENT UNDER ARTICLE 19 (1 )
Following statement explains the details of amendments in the filed claims.
Reason for Amendment: Amendment has been made in view of the observation made by the ISA in Re Item V of its WO with regard to Inventive step.
Amendment:
Pending claim 5 has been replaced by amended claim 5.
Claims 2 and 3 have been replaced by amended claims 2 and 3.
Claims 1,4,6,7 and 8 remain unchanged.
Explanation:
Earlier Filed Claim 5 was not in conformity in accordance' with PCT Article 17(2)(a)(i) and rule 39 .1 (iv).
4. The amended claim 5 now does not direct towards the method of treatment or diagnosis of human beings but towards the method of use of portable and smart intensive care unit of the present invention which comprises various steps and thus now is in accordance with PCT Article 17(2)(a)(i) and rule 39 .1 (iv).
Documents Dl and D2 were cited by the examiner in view of INVENTIVE STEP AND OBVIOUSNESS for claims 1 -4 and 6-8.
Dl and D2 do not contain any vital sign machine and/or vital sign sensors or any Infusion Pump which is the heart of the present invention. Neither Dl nor D2 can be used for emergency treatment of critically ill patients.
Intensive Care Unit of present invention cannot work without the essential hardware which is vital sign machine and/or vital sign sensors and a specially developed Infusion Pump. The software and interfaces used are useless if these hardwares are not attached to the patient body. Therefore the invention DOES NOT comprise of ONLY software which can be easily developed by a person skilled in the art. Inventive Step clearly lies in developing and disclosing a complete intensive care unit capable of remotely diagnosing and dispensing lifesaving drugs to critically ill patient. Complete mechanism of how the drug can be infused into the patient without the doctor being present on site, and with the help of smart phone of doctor having an application is disclosed. Even the printing of pathological reports from the data collected from the database is also disclosed. The working of the system being carried out using mobile phone, even the anticipated time of reaching the patient in hospital can also be calculated using GPRS of mobile phone itself.
Therefore the present invention is a boon to the mankind in terms of saving life of critically ill patients or accident victims who can be injected lifesaving drugs at the time of transit.
None of the prior art patents is directed towards above motive and thus it is clear that the present invention is completely different and not anticipated by the above prior art documents.
Effect of Amendment:
With this explanation and amendment, the inventive features of the present invention have been duly highlighted and introduced in the claims 1 to 8. It now appears that the same qualify the criterion inventive step, Novelty and Industrial Application being already accepted by the learned examiner.
